ARA and the Taxation of the Proceeds of Crime

The Assets Recovery Agency (ARA) has been granted very wide powers to confiscate what are said to be the proceeds of crime under the Proceeds of Crime Act 2002 (POCA). These powers include powers to obtain banking information confiscation orders and freezing injunctions against individuals and businesses.
 
This article does not address the position of the drug dealer on benefits (convicted or otherwise) driving a BMW and draped in gold jewellery. Such people can look after themselves. We question though whether the apparently unfettered use of the ARA powers in the area of taxation is fair or appropriate.
