I have to admit that this is an article about the new tax penalties regime — but please don't stop reading yet: the new penalties regime is more interesting than you might think. It was not my first thought on returning to work late last year after more than a year off to bring myself up to date on the new penalties regime enacted in Finance Act 2007. It was only more recently when asked to write on the subject that I did a double-take. Had HMRC having failed to eradicate tax avoidance by more conventional methods such as a GAAR come up with a more effective solution by the back door...
