Government pauses changes to interpretation of EU case law

The UK government has halted changes to the interpretation of assimilated case law that otherwise were to have taken effect from 1 October 2024.

The Retained EU Law (Revocation and Reform) Act 2023 (Commencement No 2 and Saving Provisions) (Revocation) Regulations SI 2024/976 revoke the Retained EU Law (Revocation and Reform) Act 2023 (Commencement No 2 and Saving Provisions) Regulations SI 2024/714 with effect from 18 September 2024.

This means that those earlier Regulations will now not have effect and consequently Retained EU Law (Revocation and Reform) Act 2023 s 6 will not be brought into force on 1 October 2024. REUL(RR)A 2023 s 6 would have amended the EU Withdrawal Act 2018 s 6 and introduced new ss 6A–6C.

The overall effect of the changes which have now been halted would have been to update the way assimilated law (previously retained EU law)...
