HMRC publishes phishing list

HMRC has published a list of recent letters it has sent out to individuals and businesses, covering various subjects from self-assessment to Pillar Two international tax reform. HMRC suggests that, if a letter received is not on the list, it may be part of a scam. Although, the note also directs readers to HMRC’s more extensive list of contacts ‘that use more than one communication method’.

One recent such contact from HMRC was the ‘one to many’ letter, sent to businesses which HMRC considers may not have paid the correct amount of income/corporation tax or VAT because of electronic sales suppression (ESS – essentially, misuse of their till systems). The campaign encourages business to voluntarily disclose under-reported sales to HMRC, and the letters are expected to continue being sent out in May 2023.

The CIOT notes that businesses may opt to make a disclosure under the contractual disclosure facility instead, to gain protection from criminal prosecution for tax offences ‘so long as they make a complete, open and honest disclosure of all deliberate behaviour and HMRC accepts them into COP9’ and with such protection not available under the online disclosure method set up specifically for ESS declarations.
