HMRC to issue new guidance on R&D and IR35

The Treasury’s December 2023 Minutes Progress Report provides a roundup of UK government responses to Public Accounts Committee (PAC) recommendations on various subjects. Hidden away in the extensive report (which runs to some 244 pages) are two areas of particular interest:

  • HMRC intends to ‘share a further plan for improving compliance in research and development tax reliefs in winter 2023’ after the PAC urged HMRC to set out how it would reduce error and fraud in R&D claims (page 68 of the report); and
  • HMRC ‘also identified some areas of the [off-payroll working] rules which may cause certain sectors difficulty and is providing support on these’ in new guidelines to be published ‘by the end of December 2023’ (page 92 of the report).

HMRC have recently published Guidelines for Compliance with the off-payroll working rules. It is not clear whether these are the ‘new guidelines’ mentioned in the report or whether further targeted guidance can be expected in the coming weeks.
