The Petroleum (Transfer of Functions) Regulations, SI 2016/898, transfer oil and gas licensing and certain taxation functions from the secretary of state for energy and climate change to the new Oil and Gas Authority with effect from 1 October 2016. The functions being transferred in relation to taxation include determining oil fields and cluster areas, which are required for the purposes of assessing tax liability. The regulations also provide for the transfer of responsibility for onshore oil and gas licensing in Scotland to Scottish ministers, with effect from the date of commencement of Scotland Act 2016 s 48.
