The CS has dismissed HMRC's appeal against Special Commissioners' decision no 637 reported at [2008] SSCD 258. Trustees of various family settlements had granted rights to various mining companies to extract coal and to disturb other minerals for the purpose of mining coal. The companies made payments to the beneficiary of the settlements.
