The House of Lords' decision in Governor and Company of the Bank of England v Three Rivers District Council and others [2004] UKHL 48 (Three Rivers) came out at long last on 11 November 2004. Whilst overall it represents a significant improvement over two prior Court of Appeal decisions it nonetheless contains disappointing elements as well as an unexpected warning about possible future developments.
