The Scottish Courts and Tribunals Service (SCTS) has issued new guidelines for taking evidence from overseas in the Scottish tribunals, including the First-tier Tribunal for Scotland and the Upper Tribunal for Scotland.
Where evidence is to be provided by telephone or video by a witness located outside the UK and that witness is unable to give evidence from within the UK, the relevant party is asked to contact the tribunal to inform them of their intention to bring such evidence, and confirm whether the proposed witness is a citizen or a resident of the country in which they are located.
The point of the guidelines is to make sure SCTS can determine whether or not the other country allows the giving of evidence from their jurisdiction.
The guidelines are in line with those being followed in relation to tribunal proceedings in England and Wales.
