Transfer pricing: OECD announces further consultation

The OECD has published comments received on its discussion draft on the transfer pricing aspects of intangibles. Contributors included the CBI, CIOT, ICAEW and major firms of accountants.

The responses run to almost 1,000 pages. The ICAEW said it had ‘major’ concerns regarding valuations and a ‘lack of clarity’ in the definition of intangibles, which could give rise to unnecessary disputes between business and tax authorities and between tax authorities themselves.

The OECD also published comments received on discussion drafts on timing issues relating to transfer pricing and the revision of the guidelines on safe harbours.

The responses will be discussed by a working party of the OECD’s Committee on Fiscal Affairs at its November 2012 meeting, and at a public consultation in Paris on 12-14 November.
