Five key developments in 2011 affecting the taxation of private clients are as follows:

1. Progress towards a statutory residence test

In June 2011 HM Treasury and HMRC published a consultation document on the introduction of a statutory residence test to apply for income tax capital gains tax and inheritance tax purposes. The proposed test combines day counts and other factors including the presence of family in the UK the availability of accommodation in the UK and if applicable the amount of work carried out in the UK.
