Government launches employment rights consultations

Further to the publication of the Employment Rights Bill the UK government has released the following for consultation under the general heading of ‘Making Work Pay’:

  • Collective redundancy and fire and rehire: looking at measures to strengthen the collective redundancy framework (including increasing the cap on the maximum protective award which a tribunal can award for failures in relation to collective consultation requirements) and protections for employees against ‘fire and rehire’ practices. The Employment Rights Bill (clause 22) provides that fire and rehire practices will be included in the list of unfair reasons for dismissal. The new consultation looks at the potential for granting interim relief to employees who bring an unfair dismissal claim under that new right.
  • Application of zero hours contracts measures to agency workers: inviting views on measures in the Bill to protect agency workers from ‘one-sided flexibility’ in zero-hours contracts.
