Enterprise Management Incentives (EMI) have been on the statute book for 10 years. They remain the most tax-effective of all share incentives. This article looks at some of the ways in which companies and their employees can derive maximum benefit from the EMI legislation while avoiding its pitfalls.

A key attraction of EMI is that an individual can hold EMI options over shares with a market value on grant of up to £120 000 (ITEPA 2003 Sch 5 para 5(1)). The equivalent limit for approved company share option plans (CSOPs) is only £30 000 (ITEPA 2003 Sch 4 para 6(1)).
