Overpaid import VAT on dental prostheses

HMRC has published a new VAT brief covering retrospective claims for overpaid import VAT on imports of dental prostheses. Autumn Budget 2021 announced that, from 28 October 2021, dentists (or those importing on their behalf) would be able to exempt imports from VAT (explained in HMRC Brief 14/2021). Claims can also now be made retrospectively for dental prostheses imported from 1 January 2021.

Revenue and Customs Brief 7/2022 sets out guidance for making retrospective claims in two sections:

  • businesses which used postponed VAT accounting to account for the import VAT on their VAT return can amend their return to claim repayment, subject to certain limits, or make a separate notification to HMRC; and
  • businesses which did not use postponed VAT accounting and paid the import VAT when making their customs declaration must complete form C285 to claim the repayment.

The brief also provides standard wording for a signed declaration which must be included alongside a claim.
