Trade remedies: the government’s proposals

Trade remedies are very much in the news. George Peretz QC (Monckton Chambers) assesses the government’s plans for a post-Brexit regime.
 

Trade remedies are suddenly a hot topic. The Trump administration has threatened tariffs against imports of steel and aluminium and against airplanes manufactured by Bombardier. Meanwhile after Brexit the UK will for the first time in almost 50 years operate its own system of trade remedies. Since trade remedies involve tax – the imposition of higher import duties on certain products – tax lawyers need to know about them.

What are trade remedies?

In essence trade remedies are mechanisms allowed by the rules of the World Trade Organisation (WTO) that WTO members can deploy to defend their own industries against ‘unfair’ foreign competition. There are two main types of trade remedies:
