The European Union (Withdrawal Agreement) Act 2020
(Commencement No. 3) Regulations, SI 2020/518 bring a number of provisions of
the Withdrawal Agreement Act into force on 19 May 2020, including s 26(1)(d)
which inserts a new s 6(5A) into the EU (Withdrawal) Act 2018 to provide a
regulation-making power to prescribe relevant courts and tribunals that can
depart from retained EU case law, the test to be applied and other
considerations which are relevant to the court or tribunal applying that test.
